TERMS AND CONDITIONS

Welcome to KP Homescapes. We are dedicated to providing superior craftsmanship and transparent business practices. These Terms and Conditions (“Terms”) govern our professional relationship and the services provided to our clients.

1. Our Services & Scope

KP Homescapes provides expert design and construction for a wide range of outdoor living projects, including:

  • Decks & Screened Porches: Custom-engineered structures designed for longevity.
  • Sunrooms & Outdoor Structures: Pergolas, pavilions, and fully enclosed living spaces.
  • Custom Outdoor Kitchens: Premium masonry, cabinetry, and appliance integration.
  • Under-Decking Systems: Specialized water-diversion solutions for under-deck areas.
  • Hardscaping & Landscaping: Patios, retaining walls, walkways, and custom plantings.

2. Technical Expectations & Material Behavior

To ensure a successful project, we believe in educating our clients on how natural and engineered materials interact with the elements:

  • Under-Decking Systems: These systems are designed for water diversion, not absolute waterproofing. While they provide a dry usable space under normal conditions, minor “nuisance drips” may occur during extreme weather or wind-driven rain. Clients are responsible for keeping deck boards clear of debris to prevent drainage clogs.
  • Wood “Checking”: Wood is a natural product. As it seasons, longitudinal cracks known as “checking” may develop. This is a standard part of the drying process and does not impact structural integrity.
  • Concrete Paver “Efflorescence”: New pavers may occasionally show a white, powdery residue. This is efflorescence, a natural salt-migration process that typically fades over time with normal weathering.
  • Stone & Countertops: Natural stone used in outdoor kitchens and hardscapes will feature inherent variations in color and texture.

3. Client Responsibilities, Utilities & HOA

  • Utility Locates: We coordinate with Miss Utility for public line marking. The client is responsible for identifying and marking all private lines, such as irrigation, invisible dog fences, or private gas/electric lines.
  • HOA Applications: We understand that HOA approvals can be complex. KP Homescapes will assist in any way possible to facilitate the approval of your HOA applications, including providing necessary drawings or technical specifications.
  • Site Access: We require consistent access to the work area and a designated space for material staging.

4. Payments & Late Fees

  • Deposits: A 30% deposit is required to begin the permitting process or to place your project on our official construction schedule.
  • Milestones: For larger builds (such as Kitchens, sunrooms, porches and larger decks), progress payments are due at specific phases as outlined in your individual contract.
  • Final Payment: Due immediately upon project completion and final walkthrough.
  • Late Fees: We charge a 2% monthly fee for any unpaid balance. The first 2% charge is applied if the invoice remains unpaid 15 days after the invoice date.

5. Warranties & Liability

  • Workmanship: We offer a Limited Lifetime Workmanship Warranty on all labor performed by KP Homescapes. We stand behind the quality of our installation for the life of the structure.
  • Materials: The warranty for all materials follows the specific manufacturer’s warranty. KP Homescapes passes these warranties directly to the homeowner; we do not provide additional warranties on third-party products (e.g., composite boards, appliances, or stone).
  • Exclusions: Our warranty does not cover damage from “Acts of God,” homeowner neglect, debris-related drainage clogs, or natural occurrences like checking and efflorescence.

6. Media Rights

KP Homescapes reserves the right to capture “Before, During, and After” media of your project for marketing and portfolio purposes. We respect your privacy and will never disclose your specific street address.
